Polymarket Alternative in Spain: Life After the 2026 Suspension

Spain was one of the first large EU markets to pull the plug. In May 2026 the Consumer Rights Ministry temporarily banned Polymarket and Kalshi for operating in Spain without gambling licences, and opened a licensing investigation (1).

What the ban covers

The measure is a temporary suspension pending investigation, not a permanent verdict. But the underlying question is hard to unwind: Spanish law requires a gambling licence for products that pay out cash on the outcome of an uncertain event, and neither platform held one. Spain joined France, Belgium, the Netherlands and Romania in limiting or blocking access (2).

Two months later France went further and ordered ISP-level blocking (3). In September 2026 ESMA said the major platforms lack EU authorisation entirely (4).

Will licences fix it?

Possibly, eventually — and at a price. A licensed prediction market in Spain would look very different: identity checks, deposit limits, self-exclusion, gambling taxes, and restrictions on which events can be listed. Political event contracts in particular sit uncomfortably inside gambling regimes.

So even the optimistic path does not restore the 2025 experience. It produces a smaller, slower, licensed product.
